GENERAL TERMS AND CONDITIONS OF SALE
Matani Paris is a jewellery retailer.
These General Terms and Conditions of Sale define the rules applicable to the sale of jewellery on the site,
Between
Matani Paris, whose registered office is located at 2 ter rue de la Borne, 94170 Le Perreux-sur-Marne, registered in the registre du commerce et des sociétés under number 849 578 828
And
Any person, non-commercial, having the legal capacity to contract, exclusively domiciled in the countries delivered by www.mataniparis.com (hereinafter referred to as "the Customer") making a purchase of a Product on the Site.
For the purposes hereof, it is agreed that the Client and Matani Paris shall be collectively referred to as the "Parties" and individually referred to as the "Party".
These general terms and conditions (hereinafter referred to as the "General Terms and Conditions of Sale") govern the sale of Products by Matani Paris without restriction.
Matani Paris reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site. The applicable General Terms and Conditions of Sale are those in force on the Site on the date of placing the order by the Customer; it being specified that any order of a Product offered on the Site implies the full and complete adherence of the Customer to the General Terms and Conditions of Sale in force at the time of placing his order.
ARTICLE 1: PURPOSE
The purpose of these General Terms and Conditions of Sale is to define the conditions under which the Products are marketed by Matani Paris to the Customer. They thus regulate the various stages of the sale: from the placing of the order by the Customer to the delivery of the Product(s) to the Customer.
ARTICLE 2: PRODUCTS
The Products offered for sale by Matani Paris are those appearing on the Site on the day of its consultation by the Client. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price and available sizes. Minimal differences between a Product and its photograph may exist, depending in particular on the resolution and colour definition of the user's screen or given the materials, a slight difference in size or colour. Handmade by craftsmen, the jewellery can have irregular details, reflecting its authenticity.
Matani Paris undertakes to deliver Products that comply with current regulations relating to the safety and health of persons in accordance with European provisions, and in particular with the legislation on regulated chemical substances.
ARTICLE 3: PRICE
Prices are indicated in euros, all taxes included, excluding delivery costs; it being specified that the value added tax is the one in force on the French metropolitan territory on the day of the validation of the order.
The prices applied are those communicated on the Site and confirmed to the Customer at the time of validation of the order.
Delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed inclusive of all taxes. These costs are borne by the Customer and are invoiced in addition to the selling price of the Products.
The transfer of the risks of loss and deterioration of the Products shall be carried out after delivery and receipt of the Products by the Customer.
We reserve the right to change our prices at any time but we undertake to apply the prices indicated on the Site at the time of your order.
We inform you that in the event of the display of an erroneous, obviously derisory price (vile price), for any reason whatsoever (computer bug, manual error, technical error...), the order - even validated by us - will be cancelled, which we will inform you as soon as possible. You will then be able, if you wish, to place your order again at the corrected and exact price.
ARTICLE 4: ORDER
After validation of the payment, the customer receives an e-mail informing him that his order has been registered. Any recorded order implies acceptance of the price and description of the product.
Registration does not necessarily mean acceptance by Matani Paris.
Matani Paris reserves the right not to validate the order in the event of:
abnormal or abusive claims,
orders that are abnormal in relation to the quantities ordered,
abnormal or abusive exchanges and returns,
existing dispute(s) with the client,
inaccurate information provided by the customer.
ARTICLE 5: PAYMENT
The payment of items online is done by credit card. The accepted cards are: Carte Bleue, Visa, Eurocard Mastercard.
Matani Paris makes every effort to ensure the confidentiality and security of data transmitted over the Internet.
The transaction is carried out and secured by WIX. The website uses a secure payment module such as SSL (Secure Socket Layer). All data exchanged on the web is encrypted.
The payment is completely secure.
ARTICLE 6: DELIVERY
Matani Paris will deliver orders within a maximum of fifteen (15) working days for delivery to Metropolitan France, starting from the day following payment of the order.
Upon receipt of the order, Matani Paris recommends that the customer check the conformity of his order and inform him, if necessary, of any anomaly concerning it, within 24 hours during working days, the following Monday for a reception on Saturday. After this period, Matani Paris cannot be held responsible for any non-conforming delivery.
ARTICLE 7: RECEIPT OF THE ORDER - COMPLAINTS - RETURNS
Upon receipt of the order, Matani Paris recommends that the customer check the conformity of his order and inform him, if necessary, of any anomaly concerning it, within 24 hours during working days, the following Monday for a reception on Saturday. After this period, Matani Paris cannot be held responsible for any non-conforming delivery.
Matani Paris undertakes to refund within 30 days any item with hidden defects or quality problems upon receipt of the product. The refund will be made, depending on the case, by crediting the bank account or in the form of a credit note on the site.
The costs of return and reshipment will be borne by the customer.
In the event of a model or article error during the preparation of the order, Matani Paris undertakes to exchange the article. The costs of return and reshipment will be borne by the seller.
In the event of abnormal or abusive complaints, Matani Paris may refuse to serve a subsequent order.
ARTICLE 8: RIGHT OF WITHDRAWAL
The Customer has a legal period of fourteen (14) clear days from the date of receipt of his order to return the Products ordered, without justification or penalty.
For any return under the right of withdrawal, the following procedure must be fully respected:

The risks and costs of return are the exclusive responsibility of the Customer.
Matani Paris reserves the right to refuse any return that does not comply with the above conditions.
ARTICLE 9: LIMITATION OF LIABILITY
Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, in particular with regard to technical performance, response times, connection times, information requests or transfers, risks of interruption, risks of contamination by viruses circulating on the network and, in general, all risks related to the use of the Internet network.
Matani Paris can therefore in no way be held liable for any direct or indirect damage resulting from misuse or incident related to the use of the computer, Internet access, maintenance or malfunction of servers, telephone line or any other technical connection, the Client's connection to the Site being under its sole responsibility.
ARTICLE 10 : DROIT APPLICABLE
Les Conditions Générales de Vente sont exécutées et interprétées conformément au droit français.
En cas de litiges le client s'adressa par priorité à la société Matani Paris pour obtenir une solution amiable et à défaut d'entente, les Tribunaux de droit commun seront seuls compétents.
